By accessing or using the Rxit platform and services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Services.

These Terms constitute a legally binding agreement between you and NochTech Private Limited ("Rxit", "we", "us", or "our"), a company incorporated under the laws of India.

2. Eligibility

To use our Services, you must:

  • Be at least 18 years of age, or have parental/guardian consent
  • Be a resident of India or accessing services from India
  • Have the legal capacity to enter into binding contracts
  • Not be prohibited from using the Services under applicable laws

3. Description of Services

Rxit provides a digital platform that enables:

  • Digital storage and management of prescriptions
  • Connection between patients and licensed pharmacies
  • Prescription verification and dispensing records
  • Integration with Ayushman Bharat Digital Mission (ABDM)

Rxit is a technology platform and does not provide medical advice, diagnosis, or treatment. Our Services are not a substitute for professional medical advice.

  • Always consult a qualified healthcare provider for medical advice
  • Never disregard professional medical advice based on information from our platform
  • In case of medical emergency, contact emergency services immediately

5. User Accounts

5.1 Account Registration

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must provide accurate and complete information during registration.

5.2 Account Security

You agree to notify us immediately of any unauthorized access or security breach. We are not liable for losses arising from unauthorized use of your account.

6. User Responsibilities

You agree to:

  • Provide accurate health and personal information
  • Use the Services only for lawful purposes
  • Not share prescription information with unauthorized parties
  • Not attempt to circumvent platform security measures
  • Comply with all applicable laws and regulations

7. Pharmacist Terms

If you are a pharmacist using our Services, you additionally agree to:

  • Maintain valid drug license and professional registration
  • Comply with all applicable pharmacy laws and regulations
  • Verify prescriptions before dispensing medications
  • Maintain accurate dispensing records
  • Report any suspicious or fraudulent prescriptions

8. Intellectual Property

The Rxit platform, including its design, features, content, and technology, is protected by intellectual property rights owned by or licensed to NochTech. You may not copy, modify, distribute, or reverse engineer any part of our platform without written permission.

9. Limitation of Liability

To the maximum extent permitted by Indian law:

  • Rxit provides Services "as is" without warranties of any kind
  • We are not liable for any indirect, incidental, or consequential damages
  • Our total liability shall not exceed the amount paid by you in the past 12 months
  • We are not responsible for actions of third-party pharmacies or healthcare providers

10. Indemnification

You agree to indemnify and hold NochTech harmless from any claims, damages, or expenses arising from your use of the Services, violation of these Terms, or infringement of any third-party rights.

11. Termination

We may suspend or terminate your access to the Services at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the Services ceases immediately.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of India. Any disputes arising from these Terms or your use of the Services shall be subject to the exclusive jurisdiction of the courts in Bangalore, Karnataka, India.

13. Dispute Resolution

Before initiating legal proceedings, parties agree to attempt resolution through:

  1. Direct negotiation for 30 days
  2. Mediation through a mutually agreed mediator
  3. Arbitration under the Arbitration and Conciliation Act, 1996

14. Modifications

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to the platform. Continued use of the Services after changes constitutes acceptance of the modified Terms.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
